Terms and Conditions

§ 1 Scope
These General Terms and Conditions (GTC) apply to all accommodation contracts between the guest (“Guest”) and Fenito GmbH, Brauquartier 11/1, 8055 Graz (“Beletage Luxury Apartments”).
They apply to the rental of apartments and all related services (e.g. key codes, final cleaning, additional services).
Any differing terms and conditions stipulated by the guest will only apply if they have been confirmed in writing.
§ 2 Conclusion of Contract
By making a reservation, the guest submits a binding offer to conclude an accommodation contract.
A contract is formed through:
Sending a written booking confirmation or reservation number,
Payment of the total amount, or
Transmission of the digital access code to the apartment,
depending on whichever happens first .
Offers from Beletage Luxury Apartments are subject to change without notice.
There is no entitlement to a specific apartment; an apartment of the booked category will be provided.
§ 3 Cancellation & No-Show
Cancellation period for standard rates :
Free of charge up to 3 days before arrival
From 3 days before arrival or in case of no-show: 100% of the total amount
Non-refundable installments :
No cancellation
No refund
Payment in full upon booking
Special opening hours (New Year's Eve, February, trade fair/event):
Free of charge up to 21 days before arrival
After that, or in case of no-show: 100% of the total amount
The exact details will be provided upon request or during the booking process.
Online payment systems:
For bookings made via instant payment (e.g. credit card), changes to the booking are only possible directly via a contact request.
§ 4 Arrival and Departure / Self Check-in
Check-in is possible from 3:00 PM.
Access is exclusively digital via a door code , which the guest receives by email/SMS before arrival.Check-out must be completed by 10:00 AM.
In case of late departure, 100% of the previous day's price may be charged.
The guest retains the right to prove that the damage was less.The access code must not be shared .
§ 5 Use of the apartment
The apartments may only be occupied by the number of people specified in the booking.
Parties, events, commercial use or unauthorized overnight stays by other persons are not permitted.
The apartment and its contents must be treated with care. Any damage must be reported immediately.
Smoking is strictly prohibited in all apartments.
In case of non-compliance, a cleaning fee of up to €250 may be charged.
The guest retains the right to prove that the damage was less.Pets are only allowed with prior written consent.
§ 6 Prices & Payment
The prices applicable are those displayed at the time of the conclusion of the contract.
Prices include statutory taxes and duties.
Payment made:
by credit card
via instant bank transfer
via bank transfer (only for corporate bookings)
The entire stay must be paid in full before arrival .
If payment is not received on time, Beletage Luxury Apartments is entitled to cancel the booking.
§ 7 Deposit / Damages
Beletage Luxury Apartments may require a security deposit of up to €300 (e.g., via credit card pre-authorization).
The guest is liable for all damages caused by him, fellow travelers or visitors.
Missing or damaged items may be invoiced according to their replacement cost.
§ 8 Liability
Fenito GmbH is only liable in cases of intent or gross negligence.
No liability is accepted for valuables left in the apartment.
Liability for personal injury or damage to health is governed by the statutory provisions.
In case of disturbances, the guest is obliged to report them immediately and to make reasonable efforts to mitigate damages.
§ 9 Data Protection
The privacy policy published on the website applies in accordance with the GDPR and DSG.
Personal data is processed solely for the purpose of arranging the stay.
§ 10 Termination of the contract / Right of possession
Beletage Luxury Apartments is entitled to terminate the stay with immediate effect if:
the guest uses the apartment in a grossly negligent or unlawful manner,
repeatedly violates the house rules,
endangers or offends other guests or staff.
The full price of the stay remains due.
§ 11 Final Provisions
Changes to the terms and conditions must be in writing.
Should any part of these terms and conditions be invalid, the remainder of the contract shall remain valid.
Austrian law applies, and the place of jurisdiction is Graz.
